Practice areas
What we handle.
Six practice areas. If what happened to you doesn't fit one of them, call us anyway — we'll tell you honestly whether it's a case we can take, or refer you to a firm that can.
- 01
Car Accidents
Rear-end collisions, intersection crashes, DUI victims — serious injuries demand serious counsel.
- 02
Workers' Compensation
Construction, warehouse, healthcare, office. The full New Jersey workers' comp claim from first petition to final award.
- 03
Wrongful Death
Catastrophic loss. We handle these cases with the care and the resources they require.
- 04
Premises Liability
Slip and fall. Negligent security. Dangerous conditions. Property owners have a duty of care — we hold them to it.
- 05
Product Liability
Defective products. Dangerous drugs. Faulty medical devices. When manufacturers cut corners, people get hurt.
- 06
Truck Accidents
Commercial truck collisions. Federal regulation, driver logs, black-box data — a different kind of case entirely.
Why Marsh & Driscoll
Three reasons the firm you choose matters.
-
Advisors. Advocates. Attorneys.
We know that with catastrophes come the burden of medical bills, lost wages, and so much more. Our aim is to help our clients through the most difficult journey of their life — together, every step.
-
Trial attorneys who are actually ready to try the case.
While going to trial isn't always the right decision, it is imperative that the firm representing you has the skills, resources, and experience to do so — and that your adversaries know they do. Without those three things, no firm can maximize your recovery.
-
A specialist, not a generalist.
Other firms try to practice as many areas of law as possible. We don't. We specialize exclusively in representing injured victims. It is all we do. Just like choosing a surgeon — in the end, experience matters.

FAQ
Common questions, honest answers.
If what you need to ask isn't here, call us. The intake conversation is free and we won't pressure you into signing anything that day.
How much does it cost to hire you?
Nothing up front. Marsh & Driscoll handles every personal injury case on contingency. We only get paid if there is a recovery, and our fee comes out of the settlement or verdict. Consultations are free. No hourly bills. No retainer. No surprises.
How long do I have to file a claim in New Jersey?
For most personal injury claims, two years from the date of the accident. Workers' comp has its own two-year window from the date of injury or last authorized treatment. Claims against public entities have much shorter deadlines — sometimes 90 days to put the entity on notice. Call us the week the accident happens, not the week before the deadline.
What is my case worth?
That depends on your medical bills, lost wages, future earning capacity, pain and suffering, and the available insurance coverage. In a free consultation we review your records, pull the policies, and give you a realistic range — not a sales pitch, not a guess.
Do I have to go to court?
Most cases settle before trial. We prepare every case as though it is going to trial — because that is the only way to settle one for its full value. When a case does need to be tried, we try it ourselves. Our attorneys have been in Middlesex County courtrooms for more than two decades.
What if the insurance company offered me a settlement already?
Do not sign it. The first offer is almost never the real value of the case. Call us for a free review. If the offer turns out to be fair we will tell you. If it is low — and it usually is — we will tell you what we think it is actually worth and what it would take to get there.
What if I was partly at fault?
New Jersey follows modified comparative negligence. As long as you are 50% or less at fault, you can still recover — the award is reduced by your percentage of fault. Partial fault does not mean no case. Call us and we will tell you what we see.
